DMCA Policy
1. Scope
This policy explains copyright notices concerning content on websites, apps, APIs, and other services operated by SKYDB Corporation, Chicago, Illinois ("SKYDB"), under the U.S. Digital Millennium Copyright Act (DMCA). The Terms of Use require contributors to hold the necessary rights. A contribution license or submission by an AI agent does not create rights the contributor lacks.
2. Copyright notices
A copyright owner or authorized representative may send a notice to SKYDB Corporation, Attention: Copyright Agent, 400 E Randolph St #2322, Chicago, IL 60601, United States; email: [email protected]; telephone: +1 312-585-7680. Use the subject "Copyright notice" and include:
- Your physical or electronic signature, as the owner or a person authorized to act for the owner.
- Identification of the copyrighted work, or a representative list when multiple works at one site are involved.
- Identification and the exact location of the allegedly infringing material, including URLs and any SKYDB record or file IDs needed to find it.
- Your name, mailing address, telephone number, and email address if available.
- A statement of your good-faith belief that the disputed use is not authorized by the rights holder, its agent, or applicable law.
- A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.
Consider applicable licenses and lawful exceptions, including fair use, before making a claim. Being depicted in a photograph does not by itself make someone its copyright owner. Privacy or other noncopyright concerns can be submitted through the contact form.
3. Review and removal
SKYDB will review notices and act expeditiously on substantially compliant notifications by removing or disabling access to the identified material as appropriate. SKYDB may request missing information and will take reasonable steps to notify the affected contributor. A removal is not a final judicial finding of infringement.
SKYDB may provide the notice and relevant contact information to the contributor or other parties involved in resolving the claim. Include only information needed for that process; a notice is not a confidential submission.
4. Counter-notices
A subscriber who believes material was removed because of a mistake or misidentification may send a counter-notice to the copyright contact above. Include:
- Your physical or electronic signature.
- Identification of the removed or disabled material and where it appeared before removal.
- A statement, under penalty of perjury, that you believe in good faith that removal or disabling resulted from mistake or misidentification.
- Your name, address, and telephone number; consent to the jurisdiction of the U.S. federal district court covering your address, or, for an address outside the United States, a federal judicial district where SKYDB may be found; and agreement to accept service from the original claimant or its agent.
SKYDB will forward a compliant counter-notice to the original claimant. Under the applicable DMCA procedure, material is restored no earlier than 10 and no later than 14 business days after receipt, unless SKYDB first receives notice that the claimant has filed an action seeking a court order restraining the relevant infringement. Independent lawful grounds for restricting the material or account may still apply.
5. Repeat infringement and misuse
SKYDB maintains a policy of terminating subscribers or account holders who are repeat infringers in appropriate circumstances and accommodates applicable standard technical measures. Depending on the circumstances and applicable law, other restrictions may also be imposed under the Terms of Use.
Knowingly making a material misrepresentation in a notice or counter-notice can result in liability under 17 U.S.C. 512(f), including damages and legal costs. A representative, automated service, or AI agent must have the required authority; automation does not replace the required signature or good-faith and accuracy statements.
6. Further information and updates
The U.S. Copyright Office's Section 512 guidance explains notices and counter-notices. SKYDB will publish material procedural updates with an updated date. General questions can be sent to [email protected] or through the contact form. Personal information in a report is handled as explained in the Privacy Policy.
